Rider & Driver Terms
DRAFT PENDING LICENSED US TNC COUNSEL REVIEW
Private owner/QA testing only. No real rides, charges or payouts. Not legally approved.
Draft dated October 12, 2026 · drive-rideshare-terms-draft-2026-10-12-v2
Private testing only
DRIVE is a US-only rideshare platform operated by Drive - Kansas LLC. This draft describes intended Rider and Driver responsibilities; it is not counsel-approved or authorization to operate a transportation network company (TNC). Only the owner and authorized QA accounts may simulate rides. No real passenger transportation, real charges or payouts are permitted. Accept & Continue records acknowledgment of these draft testing documents, not acceptance of a reviewed launch agreement.
Rider obligations
Provide accurate pickup and destination details, use seat belts, follow applicable passenger-safety and child-restraint laws, and treat drivers and others respectfully. Do not harass, discriminate, threaten, damage a vehicle, carry unlawful items, or request unsafe or illegal driving. Do not request transportation if an emergency requires 911. Launch eligibility, minors and accessibility rules require counsel review before real rides.
Driver obligations
Each driver represents and warrants responsibility for keeping a valid driver’s license and all required permits, a roadworthy and legally registered vehicle, and active, legally sufficient automobile insurance. Coverage must include any required rideshare, transportation-network or commercial endorsements or policies applicable throughout app-on/available, accepted/en-route-to-pickup and passenger-trip periods, as required by the operating jurisdiction. A personal auto policy may exclude rideshare use. Provide accurate, current proof of license, registration, inspections, insurance and required checks; immediately report lapses, suspensions, cancellations, material changes and safety incidents to DRIVE, and stop offering trips if any requirement is unmet. Cooperate with lawful accident reporting, insurers and claims investigations. To the extent permitted by law, drivers are responsible for their own driving, traffic violations, negligence and conduct during trips. Never drive impaired, distracted or fatigued; comply with traffic, nondiscrimination, accessibility and safety laws. Uploads and reviewer decisions are not proof of insurer coverage or a completed third-party background or driving-record check. Required background/MVR screening, identity/license checks, insurance verification and jurisdictional approvals must be completed before real operation.
What Drive-verified means for riders and drivers
A driver may be described as “Drive-verified” only after actual completion and review of required background screening, identity and license checks, and all other checks required for that driver’s operating jurisdiction, with results meeting the applicable eligibility requirements. Drivers undergo these required checks before approval for real trips; private QA approval is only permission to simulate testing and is not Drive-verified status. Never describe a driver as verified when required checks are pending, stale, expired, not actually performed or no longer sufficient for that jurisdiction. Verification is limited to the scope, records available and time of screening; it is not independent government certification, a prediction of future conduct or a guarantee of flawless safety. Riders should understand that drivers remain responsible for their own driving and legally required insurance, while DRIVE’s nonwaivable platform obligations remain. No connected screening vendor or completed live verification is claimed by this testing draft.
Platform and driver roles
DRIVE provides software for requesting, matching, communicating and recording trips. Drivers are intended to provide transportation independently, but legal classification and DRIVE’s own TNC, insurance and safety responsibilities depend on applicable law, not this label. Qualifying automobile/TNC coverage may also be required of DRIVE itself, depending on applicable law and the operating arrangements. Neither driver insurance warranties nor these agreements waive or transfer DRIVE’s statutory insurance obligations or other nonwaivable responsibilities. DRIVE does not disclaim responsibilities imposed on it by statute or misrepresent its actual services. Approval to test is separate from legal eligibility and Stripe payout readiness.
Limited driver indemnification — proposed, subject to counsel approval
Only to the extent permitted by applicable law, the proposed Driver agreement would require a driver to indemnify DRIVE for third-party claims and reasonable losses only to the extent caused by that driver’s negligent or unlawful driving, misconduct, or material breach of the driver’s lawful obligations. Any allocation must reflect the driver’s actual responsibility, with appropriate notice and a fair opportunity to participate in the claim. It must not cover losses caused by DRIVE’s own negligence, gross negligence, willful misconduct or breach of its duties, impose an unlawful obligation to defend, waive passenger or driver statutory protections, or displace required insurance or DRIVE’s nonwaivable TNC obligations. This proposed clause is not activated by a testing acknowledgment; counsel must approve its scope, claims procedure and enforceability before any reviewed agreement is published. It is not a guarantee that DRIVE never bears liability.
Transportation risks and legal protections
Transportation involves ordinary risks such as delays, road conditions and collisions. To the extent enforceable, participants acknowledge ordinary inherent risks; this is not a blanket release of personal injury claims. Nothing waives statutory passenger protections, required insurance benefits, nonwaivable duties, or liability for gross negligence or willful misconduct. Any future limitations on damages must be specifically reviewed for the operating jurisdiction and apply only where law permits.
Safety, accidents and claims
For immediate danger, injury or an emergency, call 911 first. Stop safely, obtain emergency assistance, comply with accident-reporting laws, exchange legally required details, and notify the appropriate insurer. Report trip-related accidents, injuries, unsafe conduct and claims to DRIVE through Help or the contact below as soon as safely possible. Preserve relevant records; reporting does not determine fault, replace an insurance claim or shorten legal filing deadlines. In-app help and trip sharing are not emergency dispatch and may be delayed or unavailable.
Fares, tips, fees and taxes
Amounts are in USD. Drivers are credited 100% of the fare and confirmed tips; DRIVE takes zero fare or tip commission and uses no surge or demand multipliers. Any separately charged payment-processing fee must be itemized and legally permitted; it is not a government tax. Taxes and government rideshare fees require verified jurisdiction-specific rules. In testing, unknown taxes are labeled not determined and $0 collected; estimates are not final lawful launch prices. Tips are optional and ratings do not require tipping. Extra tips are separate sandbox payments and never recharge the fare. No tax on tips or membership is assumed without an applicable verified rule.
Driver membership and payouts
The intended driver membership is $15 for the first month including onboarding, or $10 with a reviewer-verified qualifying existing background check, then $10 monthly. Membership does not replace safety approval, insurance or legally required checks. In this build, membership and ride checkout use Stripe sandbox only. Stripe collects identity and bank details directly; DRIVE does not store bank account numbers. Earnings credited are amounts owed, not a completed bank payout. Before launch, renewal consent, cancellation, refunds and permitted payout schedules and fees require approved disclosures.
Cancellation, refunds and receipts
Riders can cancel through available trip controls; driver cancellations and interrupted trips should be reported through Help. No host-set rental cancellation policy applies. Sandbox refunds and receipts distinguish fare, confirmed tips, processing fees, taxes and government fees, with component allocations and payment status. No real funds move. Before launch, counsel must approve and publish cancellation charges, refund eligibility, timing and treatment of fees and tips; no unannounced cancellation charge is authorized by this draft.
Separate consents, disputes and updates
General testing acknowledgment does not authorize consumer reports. Background-check/FCRA disclosures, written authorizations, adverse-action rights and jurisdiction-specific notices must be separate and approved before real screening. No binding arbitration, class-action waiver or shortened claim period is activated by this draft. Counsel must approve any future dispute process, enforceability, notice and opt-out options. Changed drafts require a new testing acknowledgment; previous records are not assent to new documents. Released terms versions change only when reviewed terms are actually approved and published.
